If you are merely detained on suspicion for driving under the influence, you have the right to refuse chemical testing. However, if you have been arrested for DUI, your driver’s license is subject to ‘statutory summary suspension’ if you refuse to submit to chemical testing. This means your driving privileges are withdrawn automatically in a separate action from your DUI case. In May of 2023, the Illinois Supreme Court ruled that passive acts of noncompliance with a search warrant for blood or urine do not support the charge of “Obstruction;” before then, refusal to submit to testing was a felony. A DUI arrest is a confusing and terrifying experience with more questions than answers. Did the police really have probable cause to pull you over? Should you have been released after that traffic stop? Was the testing at the station accurate? What if there were no drugs in your system? You need your driver’s license to get to work and how are you going to do so now?
